Introduction
These Terms of Service ("Terms") govern your access to and use of services provided by Go Cambria, Inc. ("Cambria," "we," "our," "us") — including our agency engagements and the Cambria Intelligence Platform at spapi.gocambria.com. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use the services.
Eligibility
Our services are intended for use by authorized Amazon sellers and brand owners, or their designated representatives. You must be at least 18 years of age and have legal authority to enter into these Terms on behalf of yourself or your organization.
Account Registration & Security
To access the Platform, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
Passwords must meet our security requirements (minimum length and complexity). We may enforce password expiration and account-lockout policies for security purposes.
Amazon Seller Account Authorization
The Platform connects to your Amazon seller accounts through the official Amazon Selling Partner API (SP-API). By authorizing the Platform through Amazon's OAuth workflow, you grant us permission to access your seller account data — including inventory, sales, orders, advertising, and account health information — solely for the purpose of providing the analytics and tools described on our website. You may disconnect any seller account at any time through your Platform dashboard.
Acceptable Use
You agree to use our services only for their intended purpose. You agree not to:
- Attempt to gain unauthorized access to the Platform, other user accounts, or our systems,
- Use our services to violate any applicable law, regulation, or Amazon policy,
- Reverse engineer, decompile, or attempt to extract source code,
- Use automated scripts, bots, or scrapers outside the intended interface,
- Share your account credentials with unauthorized individuals,
- Resell, sublicense, or redistribute access without our written consent.
Use of Artificial Intelligence (AI)
We use AI and large language models in the course of delivering our services. This includes drafting listing copy, generating ad creative, summarizing performance data, and producing forecasting outputs. By engaging Cambria, you acknowledge and agree that:
- Human review. AI-generated content is reviewed by a Cambria team member before it is published, sent to you, or used in your account. We do not auto-publish AI output.
- Accuracy. AI outputs may contain errors, omissions, or "hallucinations." We exercise professional judgment in reviewing them, but we do not warrant that AI-assisted analysis or content is error-free.
- Data handling. We do not submit Amazon customer PII to general-purpose AI services and do not authorize AI vendors to train models on your data.
- Ownership. Content we deliver to you — including AI-assisted copy, creative, and analysis — remains yours, subject to any third-party rights that apply (e.g., to fonts, images, or stock assets).
If you have specific restrictions on AI use within your brand, tell us during onboarding and we will document them in your engagement.
Data Handling
Our collection, use, storage, and protection of data — including Amazon-sourced data — is governed by our Privacy Policy. We comply with Amazon's Data Protection Policy (DPP) and Acceptable Use Policy (AUP) in all handling of seller and customer data.
We do not sell, share, or provide your Amazon data to any third party other than the authorized service providers described in our Privacy Policy. Data is used solely to power the analytics and services you have engaged us to provide.
Intellectual Property
The Platform — including its design, code, features, documentation, and branding — is the intellectual property of Go Cambria, Inc. and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Platform beyond the limited right to use it in accordance with these Terms.
Your Amazon seller data and the deliverables we create for you remain your property. We claim no ownership over data you provide or that we retrieve from Amazon on your behalf.
Subscription & Billing
Access to the Platform requires a paid subscription as described on our pricing page. Agency engagements are billed at the rates set out in your engagement letter or statement of work. All fees are non-refundable except as required by applicable law.
We reserve the right to modify pricing with 30 days' written notice. Continued use of our services after a price change constitutes acceptance of the new pricing.
Service Availability
We strive to maintain the availability of our services but do not guarantee uninterrupted or error-free access. Services may be temporarily unavailable due to maintenance, updates, Amazon API outages, hosting-provider disruptions, or force majeure events. We are not liable for any loss or damage resulting from service interruptions.
Termination
Either party may terminate the engagement or subscription at any time, subject to any notice period in your engagement letter. To cancel, get in touch here. Upon termination:
- Your access to the Platform will be revoked,
- Associated data — including inventory snapshots, order records, ad performance history, and creative assets — will be deleted from our active systems within 30 days,
- Any outstanding fees remain due and payable.
We reserve the right to suspend or terminate your account immediately if you violate these Terms, Amazon's policies, or applicable law.
Limitation of Liability
To the maximum extent permitted by law, Go Cambria, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services — including lost profits, lost data, or business interruption — regardless of the cause of action or theory of liability.
Our total liability for any claim arising from these Terms or your use of the services shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim.
Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will meet your specific requirements or that data, analyses, or AI-assisted outputs will be error-free.
Indemnification
You agree to indemnify and hold harmless Go Cambria, Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of our services, your violation of these Terms, or your violation of any applicable law or third-party rights.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of laws provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Suffolk County, Massachusetts.
Changes to These Terms
We may update these Terms at any time. The "Effective" date at the top of this page reflects the most recent version. Continued use after changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify you via email or through the Platform.
